General Terms and Conditions of Klangkultur.wien – As of February 2025
- 1 Scope
The following General Terms and Conditions apply to all sales between Klangkultur.wien and a consumer in the version valid at the time of the order.
- 2 Conclusion of Contract, Storage of Contract Text
(1) The following regulations on contract conclusion apply to orders placed via our website: http://www.klangkultur.wien.
(2) In the event of a contract, a binding agreement is formed between you and Klangkultur.wien.
(3) The Klangkultur.wien website provides various information about events and acts as an agent for tickets to the events displayed on the website. Klangkultur.wien is not the organizer of the events, but acts solely as a ticket intermediary. Klangkultur.wien assumes no liability for the content or quality of the events.
The presentation of products on our website does not constitute a legally binding offer but is instead a non-binding invitation to website visitors to place an order. By ordering a product, the visitor submits a binding offer to conclude a purchase agreement.
We explicitly reserve the right to modify, supplement, delete, or suspend publication of parts of the website or the entire offer without prior notice.
(4) When an order is placed via our website, the following applies: The visitor submits a binding contract offer by successfully completing the order process on our website. The ordering process includes the following steps:
- Selection of the desired product
- Confirming by clicking the “Order” button
- Reviewing the information in the shopping cart
- Clicking the “Checkout” button
- Logging into the online shop after registration and entering login data (email and password)
- Final review or correction of the entered data
- Binding submission of the order by clicking the “Order with payment obligation” or “Buy” button
Before the binding submission of the order, the visitor can return to the previous page to correct any input errors using the “Back” function of their browser, or cancel the process by closing the browser window.
We confirm the receipt of the order immediately via an automatically generated email (“Order Confirmation”), which constitutes acceptance of your offer.
(5) Storage of the contract text for orders through our online shop:
You can access the General Terms and Conditions at any time at https://www.klangkultur.wien. For security reasons, your order data will no longer be accessible via the internet after the order is completed.
- 3 Prices, Shipping Costs, Payment
(1) The prices stated include statutory VAT, which is usually 13%, as well as all other price components. Shipping costs may be added where applicable.
(2) Customers can pay via PayPal or credit card (Visa, Mastercard).
- 4 Delivery
Unless otherwise clearly stated in the product description, all tickets offered by us are issued as e-tickets and are ready for immediate delivery.
With the voucher you receive from us, tickets can be collected at the box office of the respective concert venue. Delivery is made via a confirmation email, which will explain where and how to collect the tickets at the event location
- 5 Right of Withdrawal
According to § 18 para. 1 Z 10 of the Austrian Distance and Off-Premises Contracts Act (FAGG), the right of withdrawal is excluded.
- 6 Changes to Cast and/or Program
Changes to the cast and/or program are reserved by the event organizers and do not entitle the ticket holder to a refund.
This applies to all events listed on https://www.klangkultur.wien.
- 7 Data Security
All personal data entered on Klangkultur.wien – such as name, address, telephone number, and email address – is used exclusively for booking purposes and will not be passed on to third parties, nor will it be stored after the transaction is complete (unless you subscribe to the newsletter – in which case you consent to us storing your email address).
All orders on Klangkultur.wien are conducted using SSL encryption (Secure Socket Layer mode). This means your data is encrypted during transmission and cannot be read by third parties.
When operating in SSL mode, the URL automatically switches from http:// to https://.
- 8 Disclaimer of Liability
Klangkultur.wien is only liable for direct damages caused to the customer due to non-fulfillment of contractual obligations and only up to the total invoice amount.
Klangkultur.wien is not liable for indirect or consequential damages, nor for damages incurred by third parties.
Furthermore, Klangkultur.wien accepts no responsibility of any kind for the type, content, duration, quality, or outcome of the events for which tickets have been mediated to the customer.
- 9 Jurisdiction
Austrian law applies.
